Terms & Conditions of Enrolment

 

By attending our sessions the Student agrees to the following terms and conditions. Where the Student is a legal minor, the Parent/Guardian shall enter into this agreement with Learning Space on behalf of the Student and shall accept and agree to all the terms and conditions contained herein on behalf of the Student.

 

Tuition Policy

1. Our tutors undertake to do all preparation prior to lessons and to structure lessons in such a way as to optimise time to the benefit of the Student. The Student agrees to undertake to assist the tutor in identifying problem areas in which the Student needs specific tutoring.

2. Although we work inside the Australian NSW curriculum, the tutor shall at no time be required or obliged to execute homework or assignments on behalf of the Student.

3. The Student agrees that assignments, exercises or homework form an integral part of tutoring and undertakes to complete such work in a timely manner. Repeated failure to complete homework may result in a termination of services.

4. We strive to provide the best possible service. However, we will not be held accountable or responsible for the academic success or lack thereof demonstrated by the Student. Although we will do everything in our power to help grades and skill sets improve and have done so, we can offer no guarantee or warranties thereto.

5. All materials created in-house by Learning Space or any related entity are copyright. You agree that you will not publish or distribute any portion of any materials without prior written permission from Learning Space.

6. We shall keep confidential all information of the Student and shall contact other parties involved in the education of the Student only if given permission by the Student to do so.

7. We are not liable for any direct, incidental, consequential, indirect, special, punitive or similar damages arising out of use of our tutoring service, or any errors or omissions in the content of our materials. The Student, their heirs and assigns specifically waive any and all claims arising both directly and indirectly out of the use of this tutoring service.

8. Photographs may be taken and used for promoting purposes. If the Student does not wish to partake in this, a written request must be emailed to Learning Space.

 

Fee and Payment Policy

1. Fees for tuition are determined by Learning Space. The Student will be notified in writing of any changes to fees two weeks prior to the change.

2. On the first day of every month an invoice will be emailed to the Student. The invoice will include any outstanding charges and will cover any upcoming sessions in that month. An invoice will not be emailed to the Student if there are no outstanding charges and if there is enough credit to cover the month's scheduled sessions.

3. For the convenience of the student, an automatic payment will be made on the day the invoice if the credit card details are saved in the system. This feature can be switched off with a written request emailed to Learning Space.

4. Though we are flexible with payments, all payments must be made in advance. A surcharge may be applied if a session is booked:

• Without sufficient notice of one business day;

• With a starting time after 8pm;

• For a Sunday or public holiday. Where a scheduled weekday lesson falls on a public holiday, the session will be cancelled and the cost will be credited to the Student.

 

Lateness and Cancellation Policy

1. Fees are calculated according to the times and dates agreed to by Learning Space and the Student. No adjustment shall be made for time lost because of the late arrival by the Student.

2. Any lost time because of the late arrival of the Tutor shall be compensated for by extending a lesson by mutual agreement and by such amount of time that was lost.

3. As sessions are kept small, we have limited seating, as such a commitment of the school term is required. A scheduled tutoring session in the term may not be cancelled. A student in a group session may attend a different session in the week provided that 24-hour notice is given via email or text. Cancellations or failure to attend without notice (hereafter referred to as a “no show”) are subject to a penalty of 100% of the session fee for each and every occurrence.

4. Repetitive late cancellations and/or no shows may result in termination of service.

5. In the event that the tutor cancels, the tutor shall reschedule the appointment at a time agreeable to both parties, failing which the Student shall be credited with such a missed session fee.
